Sumner Loses Casc Against Arthur Schnitzler's Movel
Grand Jury Refuses To Indiet Book Attacked By Vice Society
Tho rencwed ccmplaint of John S. Sumner, chief agent of The
New York Society Por the Suppreszion or Vice, against Arthur Schnitzleris
novel,Casanovals Homecoming“, published by Simon and Schuster, was
dismissed by The Grand Jury of New York County yesterday after it had
read and considcred the book.
Sunner charged that the novel was being published and distrib¬
uted in violation of Scotion 1141 of the Ponl Code prohibiting the sale
of obschne Iiterature.
An #arlier complaint ag inst the book had been dismissed on
September 25th, 1930 by magistrate Hlaurice Gottlich. The opinion of tho
Court was delivered after liagistrate Gottlicb had rend the bock itscif
and carefully studied briefs subnitted by Simon and Schuster's attorncys,
Messrs. Grcenbaun, Volff and Ernst. Tue Court heard arguments presented
by Nr. Horris L. Ernst and Nr. Nouman Levy, of counsel for the publish¬
ers, and studicd a comprchensive memorandum in which werc sct forth rep¬
resnhtative opinions on the bock from editors, critics, ninisters, educ¬
ators, physicians, and other lenders in the commmity.
In bis decision, absolving Wasanovals Homccoming“ from any
charge of obsecnity, Megistrate Gottlich threu out of Court all the com¬
plaints fiücd by Nr. Sumer, His Honor charscterized vasenova's Home¬
coming“ as an unimpenchable classic of modern literaturc and dcc lared
that the bock mst be measured by che living standards of our oun timc,
not by thosc of the Mid-Victorian cra.
Hr. Sumner was not satisfied with the decision in the Court, and
lodged repeated complaints at the District Attorncy's officc, insisting
that the Grand Jury be rcquested to investigate. The members of that
body thereupon rcad tlic book and gesterday it was officially announced
that they found no bacis for an indictment.
This decision represents the fourth and final legal victory
